In the second part of the hearing the second part of the motion filed by Dolgikh’s new attorney, Marta Kostina, was discussed: a change of territorial jurisdiction. The judge emphasized that the application was filed after the proceedings began and does not contain sufficient evidence. Although at the morning session the lawyer, before reading the text of the motion, stated that she had handed the document in at 9:03 (the hearing began at 9:30). The court found the defense’s arguments about judicial bias and the “inefficiency” of the system in the region to be unfounded. By the way, the first part — that the judge has a biased attitude toward the defendant — was interpreted by Yan Shavshukov as a motion for recusal, which he dismissed at the start of the session after the break.
Later a conflict arose related to the fact that, according to Marta Kostina, one of the attendees (Anton Dolgikh called him almost his main “hater”) was conducting a live text broadcast from the courtroom. She and Anton Dolgikh urged that the “insulter of justice” be brought to criminal responsibility. The court officially warned that photography and filming are not permitted and stressed that recording the proceedings is only allowed with the presiding judge’s permission, and repeated violations will result in sanctions.
After the proceedings Dolgikh’s lawyer noted that additional time was needed to coordinate the position with the client, since the motion to change territorial jurisdiction was returned without consideration. The court compromised: the hearing was postponed to August 28 at 9:30, despite a request to move it to at least 10:15 because of a flight arriving from Moscow.
Emotional statements from the defendant were heard again in the courtroom. Dolgikh spoke of his confidence in being right, criticized the actions of representatives of the judicial system, and insisted on transparency in the handling of the case.
The next hearing will take place at the appointed time, where the defense will be able to clarify and supplement its motions.
