The Prosecutor's Office of the Yaran District supported the state prosecution in a criminal case of fraud (part 3 of article 159 of the Criminal Code of the Russian Federation). It was established that in February 2023, the defendant promised to help a pensioner with the recalculation of her pension, although she knew that there were no legal grounds for this. For her "services," the woman received 265,000 rubles, which she disposed of at her discretion.
The defendant did not admit her guilt and stated in court that the victim and her son were framing her due to an existing debt to her.
Taking into account the severity and public danger of the act, the information about the fraudster's personality, the absence of aggravating circumstances, and the presence of minor children in her care, the court imposed a penalty in the form of a fine of 200,000 rubles.
The defendant and her defender appealed the verdict in the appellate court, but the appeals regarding the evidence of the crime were rejected. At the same time, the appeal satisfied the victim's claims and ordered the convicted woman to pay compensation for moral damages.
