Many people face situations where, when trying to register property rights to real estate, Rosreestr suspends registration actions. The ERZ portal published a memo about when this happens and what to do.
The first case is when the Unified State Register of Real Estate (EGRN) contains no information about the boundaries of the land plot. To correct this omission, you need to contact a cadastral engineer, prepare a boundary survey (cadastral) plan clarifying the boundaries, and submit it to Rosreestr.
The second case is the presence on the land plot of a zone with special land‑use conditions. For example, this could be a power line protection zone or a water protection zone. Therefore, before starting construction it is worth requesting an extract from the EGRN for the plot, data from the NSPD, and information from the regional information system on urban‑planning activities.
The third is an incomplete set of documents. For example, when selling a room in a communal apartment, written waivers from the other owners of their preemptive purchase rights are required, and for transactions involving minors, the consent of guardianship and custody authorities. Many people do not know this. However, the problem is easily solved: missing documents can be submitted to Rosreestr during the suspension period.
The fourth is filing the application by an unauthorized person. For instance, when the documents are submitted by a representative who does not have a notarized power of attorney.
The fifth is the failure of documents to meet legal requirements. For example, providing a deed of gift for real estate and an agreement on the transfer of a share in joint ownership without notarization. In this and the previous case, you should consult a notary.
The causes of the suspension must be remedied within three months. If this is not done, Rosreestr will decide to refuse registration.
