The arbitration "delayed" the construction of schools in Kotelnich and Nolinsk by two months.

      Currently, LLC TD "Assa" is in the process of bankruptcy — on June 30, 2025, the Arbitration Court of the Moscow Region introduced a supervision procedure against the company. Previously, on March 31 of this year, a lawsuit was filed at the Kirov Arbitration Court by "Assa" against the Kotelnich Administration, which was accepted for consideration in late June. The company demands the recognition of the unilateral termination of the municipal contract for the construction of a school, concluded on March 30, 2023, as unlawful. Moreover, LLC TD "Assa" requests the Court to oblige the Kotelnich Administration to sign an additional agreement to the contract for two years (from the date the court decision becomes final) and to recognize the "expenses incurred by the claimant as necessary for fulfilling obligations within the scope of the specified municipal contract" totaling nearly 311.6 million rubles.

      But that's not all: "Assa" also demands that the municipality account for the advance payment made toward the settlement of accounts with them for this amount, and to recover approximately 30.5 million rubles from the Kotelnich budget for "unjust enrichment" under the municipal contract, plus nearly 372 million rubles in penalties accrued for improper performance under it. The Kotelnich Administration opposed the lawsuit’s satisfaction, and third parties not claiming independent demands were involved in the case.

      Additionally, another claim from the Property and Land Resources Management of the Kotelnich Urban District contesting the termination of the gratuitous land use agreement and the release of the land was filed in April of this year. The arbitration court decided in early June to suspend its review until a judicial act on "Assa"'s claim against the Kotelnich administration becomes final.

      On July 24, during the court session, "Assa" representatives demanded that the temporary manager of the company, Andrey Elyasov, also join the process. Since he was unaware of the proceedings, they asked for time to familiarize him with the case materials. The Kirov arbitration did not delay — the session lasted less than 10 minutes — and agreed to the request, scheduling the next hearing for September 25. This means the new contractor, "Rost" company, cannot take any actions on the land plot, including fencing it off — the "School of Ichthyanders" still operates there.

      On the same day, a similar decision to postpone the case until September 26 was made regarding "Assa"'s claim against the Kirov Regional Unified Customer Service (KOUBU), with a claim amount of 98.9 million rubles. The company demands recognition of the unlawful unilateral refusal to execute the school construction contract in Nолинск, to obligate the signing of an additional agreement and account for the advance payment, and to recognize the expenses incurred as necessary for fulfilling obligations, as well as to recover unjust enrichment from the state institution.

      The claim against LLC TD "Assa" filed by the Regional Property and Land Resources Department, requiring the removal of obstacles to land use, was suspended until the arbitration decision on the company's claim against the "Service of the Unified Customer" becomes final.

      It is worth noting that a new auction for school construction in Nолинск took place recently. Its conditions can be considered risky for the contractor, as the construction company will not receive an advance payment. The results have not been officially announced, but it is known that "Grazhdanremstroy" is involved. It is noteworthy that in summer 2024, the firm received funds without an auction from terminated contracts of SK "Monolit" for the construction of two residential buildings for displaced persons from dilapidated and emergency housing, having twice missed project deadlines.

      Thus, after missing all deadlines for social facilities and declaring bankruptcy, "Assa" aims to return to the sites, prolong the construction for two years, and earn a total of about 600 million rubles.

      Another notable point is that on the same day, July 24, Prime Minister Mikhail Sandalov, answering questions from the deputies of the Kirov Region Assembly, including about school construction, announced that a new contract for a school in Nолинск is planned, and construction in Kotelnich will soon resume. Moreover, the land plot in Kotelnich will be transferred to the contractor within a month. However, given the court decision, doing so legally will probably be difficult. Nevertheless, the Prime Minister's remark that "everything possible will be done" offers some reassurance.

      It should be reminded that LLC TD "Assa" was supposed to complete the schools in Kotelnich and Nолинск by the end of 2024. In January 2025, authorities announced the termination of the contracts due to delays in construction deadlines.
