The Court of Appeal reduced the amount of the recovery from the Comfort Criminal Code in favor of Severny Bereg

      The Second Arbitration Court of Appeal reviewed the decision on the dispute between two Kirov management companies — the management company "Severny Bereg" and the management company "Comfort". He changed the decision of the Arbitration Court of the Kirov region dated November 15 last year, partially satisfying the complaint of the Comfort Criminal Code.

      Initially, the Severny Bereg company filed a lawsuit against Comfort Management Company. The claims related to the non-repayment of the remaining funds collected from residents of the apartment building at 18 Podgornaya Street in Kirov after the change of the management organization. The court of first Instance fully satisfied the requirements of Severny Bereg, obliging Comfort Criminal Code to pay more than 681 thousand rubles of unjustified enrichment.

      However, the Court of Appeal, having reviewed the case file on April 9, came to different conclusions. The amount to be recovered from Comfort Management Company in favor of Severny Bereg was significantly reduced and amounted to 177 thousand rubles. The rest of the original claims were denied.
