The Second Arbitration Court of Appeal upheld the decision regarding the dispute between Eco-Trade LLC and the Kirov Regional Environmental Protection Center. The refusal to extend the landfill lease in Nolinsk was deemed lawful.
The dispute began after the lease agreement expired. Eco-Trade LLC, which previously operated the facility, sought a new contract. However, the Environmental Protection Center refused to renew the lease, prompting the company to file a lawsuit.
The grounds for the refusal were that the landfill had reached its capacity and could no longer accept waste. This was confirmed by data from the relevant ministry and Rospetrozdravnadzor. Additionally, the landfill was deregistered from the waste disposal facilities register, effectively making its further operation impossible.
The court concluded that since the landfill could not be used for its intended purpose, there were no grounds to conclude a new lease agreement. Eco-Trade LLC's claims were dismissed first by the lower court and subsequently by the appellate court.
