The scandal surrounding the construction of a school in Kotelnich, which was announced back in September 2023, is gaining momentum. The project, which involved the construction of a school for 461 students with a swimming pool and a sports and recreation complex, was supposed to be completed by the end of 2024. However, ACCA Trading House LLC, which won the tender and received an advance of 49.9% of the total contract value (311 million rubles), according to local authorities, disappeared from the Kirov region without starting work.
As it became known from the ruling of the Arbitration Court of the Kirov region, published on February 25, 2025, the Kirov regional State Budgetary Institution "Unified Customer" filed a lawsuit against LLC Trading House "ASSA" for the recovery of 206 million 733 thousand 364 rubles. 68 kopecks. unjustified enrichment in the form of an unprocessed advance payment under a government contract dated 30.03.2023.
However, the court returned the statement of claim to the "Single Customer" due to non-compliance with the claims procedure for dispute settlement provided for in the terms of the contract. In particular, the contract stipulates a 40-day period, which must pass from the moment the claim is submitted to the court. The court found that the "Single Customer" sent a request for a refund of the advance on February 10, 2025, and filed a statement of claim on February 25, 2025, without waiting for the deadline.
The situation complicates plans to resume the construction of the school, which is urgently needed by the city due to the growing number of students caused by the demographic factor. The government of the Kirov region, realizing the severity of the problem, allocated an additional more than 900 million rubles for the re-construction of the school. However, before starting new work, it is necessary to resolve the issue with the unscrupulous contractor and return the funds paid to him.
The "Single customer" will have to correct the mistakes made, comply with the claim procedure and re-apply to the court with a claim.
