      Volkova declared "double criminal responsibility" in the Dolgikh case, noting that the second article of the charge under Article 285 of the Criminal Code (Abuse of official authority) was initiated "generally illegally," which, according to her, is prohibited by the Constitutional Court. The lawyer also stressed that it was impossible to initiate criminal proceedings under Article 291.2 of the Criminal Code of the Russian Federation (Petty bribery) "in relation to Dolgikh.

      Volkova accused the court of a formal approach, when the measure of restraint was applied only on the basis of the fact that a criminal case had been initiated, without checking its legality. "In this case, in general, in principle, he had no right to be guided by a formal principle and had to verify the arguments about the legality of the initiation of criminal proceedings," the lawyer said.

      In this regard, according to Volkova, a complaint has already been filed with the Pervomaisky Court under Article 125 of the Criminal Procedure Code of the Russian Federation (Judicial Procedure for reviewing complaints) challenging the legality of the criminal case. The lawyer is awaiting the appointment of a court hearing on this complaint.

      "In our country, the initiation of the 285th case is illegal, unjustified and violates the principles of criminal law, which are set out in the Constitution, in Article 50," concluded Violetta Volkova. Further developments in the case of Anton Dolgikh will depend on the consideration of the complaint in court.
