In the department of bailiffs for the city of Kirovo-Chepetsk and the district, the enforcement proceedings regarding the determination of the order of use of the residential premises have been completed. The disputed property was a two-room apartment registered in the name of a local resident.
The family has two children: an adult daughter and a minor son. At the time of the proceedings, the daughter was living with her father, while the younger brother remained with their mother in the mentioned apartment. The girl filed a lawsuit, believing her housing rights had been violated.
The court examined the layout and the established living conditions, after which it ordered the owner to allocate a separate room for the daughter. Common areas — the kitchen, bathroom, and hallway — were prescribed to be used jointly by all residents.
After the decision came into force, the claimant turned to the enforcement service. The bailiff initiated proceedings in accordance with 229-FZ and held an explanatory conversation with the debtor. The woman was handed copies of the documents and a deadline was set for voluntary compliance.
The bailiff explained in detail the consequences of delays: enforcement fees and administrative liability for ignoring the requirements. This approach — a combination of explanation and warning — proved effective without resorting to extreme measures.
Within the established timeframe, the owner provided her daughter with the opportunity to use the allocated room. The housing rights of the citizen, secured by the court, were fully realized, and the proceedings were concluded with actual compliance.
