As lawyer Tatyana Bazhina believes, the mothers of the teenager's appeal to the court today is a necessary procedure, during which the fact of beating and causing injuries to her son will be confirmed. After all, the Verkhoshizhem police have still not initiated either a criminal case or an administrative proceeding against Yakov and Leonid for almost two months now. However, with a court ruling in place, any potential attempt to "sweep" the case under the rug, if not impossible, would be much more difficult to execute.
And while the "case of the beating of Roman Oparin" is currently quietly "resting under the rug," the Verkhoshizhem police are energetically "investigating" their own "mythical version" that allegedly "at the instigation" of Roman, another Verkhoshizhem schoolboy was beaten (most likely referring to Yakov). And in the absence of any evidence of "incitement," they are actively, as the lawyer believes, trying to extract a confession from Roman, who has taken Article 51.
Interestingly, after at least six "summons" (over a month and a half), neither Roman nor his parents received answers to their questions: when the teenager was beaten (probably at the end of April), when the complaint was filed, and what the results of the examination were. It is only known, and that from the investigator's words, that the two who beat Yakov allegedly shouted: "This is for Romka," which is essentially the basis of the accusation.
At the same time, while the legality of the actions of the Verkhoshizhem police regarding Roman Oparin can be questioned, the zeal of the district department of the Ministry of Internal Affairs in demonstrating the dynamics of rising juvenile crime in Verkhoshizhemye (which increased by 61% in the region last year) is inexplicable. Unless it is based on the assumption that Newsler.ru will not pay attention and will not write about the "repeated violence against a teenager" that occurred over two weeks in April.
Let us recall that on April 11, two possibly intoxicated schoolboys from Verkhoshizhemye, while beating a classmate, forced him to kneel and ask for forgiveness. And the "hand-to-hand process of intimidation and punishment" was recorded in detail by a surveillance camera.
However, despite the serious injuries inflicted on Roman: a bloodied face and lips, a knocked-out tooth, and a concussion, the village police could not find the attackers for several days, allegedly "because they had Easter."
And judging by the video recording, when Yakov and Leonid dealt dozens of blows to Roman, not only possible drunkenness gave the teenagers a sense of "masculinity," but also, most likely, the awareness of complete impunity, which is often characteristic of the children of officials. Especially when the mother of one of the "active lynchers" allegedly works in the local administration.
It is not difficult to guess the reasons for putting Roman on his knees. After all, last autumn, a group of six Verkhoshizhem teenagers held parties in an empty apartment of one of the private houses on Pervomayskaya Street: the boys listened to music, danced, and lived what they thought was an "adult life," so that sometimes, possibly after trying "adult drinks," they could not make it home; the sentence was only passed against Roman.
When the owner of the apartment discovered the presence of uninvited guests, a broken lock, and the disappearance of an old Husqvarna chainsaw, the police initiated a criminal case for "theft" and "illegal entry into a dwelling." And, having aggravated the charge, they forwarded the materials to the Investigative Committee.
The Investigative Committee, ignoring the "collective intrusion into someone else's dwelling" and the fact that it was not Roman but his classmate who broke the windows and opened the door lock, granted the other teenagers the status of "witnesses." They charged one Oparin with a "serious offense."
The appellate court, overturning the verdict of the Soviet district court: "to send to a closed-type special institution until reaching adulthood," found no confirmation that the ninth grader corresponded to the assigned role of "monster or psychopath." And transferred Roman under the guardianship of his mother for one year. Thus, the teenager avoided being placed "in a mental institution," where the educational process would be based on "medication rehabilitation."
They wanted to live and rejoice, but an appeal happened. The sentence handed down by the district court against Oparin satisfied all the parents of the "witnesses" — after all, their children were not held accountable for anything. And the teachers were pleased that "the boy will not go to the 10th grade"... But until the regional court separated the materials with a list of all participants in the "gatherings" into a separate proceeding, placing special emphasis on the real and first "violator of the inviolability of the dwelling" — Yakov.
Also, while investigating the case only against Roman, the investigation preferred to "not notice" that a wallet belonging to Leonid was found and recorded at the site of the stolen saw. So, despite his almost all-powerful mother, Yakov will likely have to answer not only for a serious charge but also, like Leonid, not expect that "intentional infliction of harm to health" will transition into the realm of administrative responsibility.
By the way, when the court reviewed the video evidence of the beating, Leonid's mother, patting her son on the back, allegedly said quite loudly: "Well done, that's how it should be."
Interestingly, the parents of the underage defendants, justifying their sons, told the court that Roman, according to Leonid's mother, "had been swearing at him in class for the last six months." And Yakov's mother claimed that for the last six years — that is, since... 4th or 5th grade. About which her son, by the way, who was not allowed to take exams, "modestly remained silent" all these years.
The court "adjourned" until June 23, inviting to the next session almost the entire teaching staff of the Verkhoshizhem school: the principal, the deputy principal, the social teacher, and the class teacher, who for some reason "did not react to the swearing tirades" of then 9-year-old Roman for six years.
