      At present, in accordance with Federal Law No. 217-FZ, the general meeting of members of an SNT has the authority to independently amend the land surveying plan of the territory, including changing the boundaries of the gardening association. This is possible, for example, when new plots are included for common-use facilities or when garden plots whose owners have decided to join the partnership are annexed, the press service of Rosreestr reports.

      The new bill proposes to introduce the mandatory consent of the owners of land plots that are planned to be included within the SNT boundaries. It is assumed that such a measure will protect the rights of landowners and reduce the risk of legal disputes in the future — in particular, in attempts to impose on them obligations to maintain common property without their consent.

      Rosreestr notes that the changes are aimed at simplifying the registration of property rights and increasing legal certainty for gardeners. The document is currently being prepared for submission to the Government of the Russian Federation.
