It has been revealed whether the long New Year holidays will affect salaries in January.
The extended New Year holidays will not affect the amount of salary for employees who receive a fixed salary. As Alexander Yuzhalin, head of the legal practice at SuperJob, said, the presence of non-working public holidays in a month, in accordance with Article 112 of the Labor Code of the Russian Federation, does not affect the amount of the fixed salary. Thus, salaried employees will not lose money in January.
Changes are possible for employees with an hourly wage rate or piece-rate pay. In this case, the final amount will depend on the number of hours actually worked or the volume of work completed. Moreover, if such employees do not work during the period from January 1 to 8, the employer is obliged to pay them additional compensation. Its amount must be established by the organization's local regulatory acts. Work on non-working public holidays is paid at double the regular rate.
Employees may also have questions about the size of the advance payment, the payment for the first half of January. Since wages are accrued proportionally to the time worked, the first half of the month contains a small number of working days, which makes the advance smaller than usual. However, in the second half of January the payment will be higher, and ultimately the total amount of wages for the month will remain the same.
