A Kirov entrepreneur won a court case over a drawing on piggy banks.
Recently representatives of the Nizhny Novgorod company "Empire of Greetings" filed a lawsuit in the Arbitration Court of the Kirov Region against a local entrepreneur. They demanded recovery from him of more than 2.14 million rubles in compensation for copyright infringement of the drawings "Girl and Boy in Military Uniforms Wearing Pilotkas with Red Numbers," as well as other expenses. The defendant did not agree with the claims.
The court found that last year the plaintiff discovered on a marketplace piggy banks that were being sold by the defendant. The plaintiff concluded that the drawing on those piggy banks was exactly the same as one created by one of its employees. The plaintiff sent the defendant a claim demanding that the disputed product be removed from sale and that compensation be paid; however, they were unable to reach an agreement, and the matter went to court.
The court ruled to deny the claim. It explained this by saying that the plaintiff had not properly proven its right to seek payment of compensation. The company attempted to appeal the decision, but the Second Arbitration Appellate Court left it unchanged.
