
A "gray" hiring scheme at a farm was uncovered in the Sovetsky District.
The Prosecutor's Office of the Soviet District of the Kirov Region conducted an inspection of compliance with labor legislation at one of the agricultural enterprises.
According to the regional prosecutor's press service, it was found that from March to July of this year the organization's management allowed an operator of dairy equipment to work without entering into an employment contract. At the same time, social insurance contributions and tax withholdings were not made from his earnings.
Following the inspection, the prosecutor filed a lawsuit with the court seeking recognition that the de facto relationship was an employment relationship. In addition, the supervisory authority is demanding that the employer be obliged to formalize the necessary documents, make all contributions and withholdings, and also pay the worker compensation for moral harm caused by the violation of his labor rights.
The lawsuit is currently pending before the court.
