The court partially granted the claim by an individual entrepreneur against the Kirov-based company "Umny Vending".

      In May the Arbitration Court of the Kirov Region partially granted a claim by an individual entrepreneur from Kazan against the company Smart Vending. The entrepreneur sought to recover 433,000 rubles in damages from the defendant related to non-performance of a franchise agreement.

      The dispute arose from an agreement for the use of vending photocopiers concluded in June 2024. Under the terms of the agreement, the entrepreneur obtained the right to open five vending-machine locations for 1.9 million rubles. Additionally, the businessman paid for a VIP package for 250,000 rubles, which included selecting locations for the machines, assistance in negotiations with landlords and review of lease terms.

      However, the cooperation fell through. A month after signing the agreement the entrepreneur demanded termination of all contracts and a refund. He claimed that the company had not provided location options for the machines and had not provided the promised assistance.

      Representatives of Smart Vending, in turn, said they had sent the entrepreneur 12 location options, which constitutes 80% of their obligations. The company admitted that it had failed to provide locations for only one of the five machines, which in monetary terms amounted to 50,000 rubles.

      The court reached roughly the same conclusions. As a result, only 50,000 rubles were recovered from Smart Vending; the remainder of the claim was denied.

      The entrepreneur attempted to appeal the decision. Recently the Second Arbitration Appellate Court left it unchanged.
