The Arbitration Court of the Volga-Vyatka District has finalized the dispute between "Kommunenergo" and "Kirovenergo." It upheld the decisions of lower courts and ordered the "Rosseti" branch to pay "Kommunenergo" a fine of over 181 million rubles.
It should be noted that the dispute arose due to the untimely payment for electricity transmission services provided in early 2023. "Kirovenergo" repaid the principal debt of approximately 193 million rubles but did so late. As a result, "Kommunenergo" filed a suit demanding the recovery of penalties for overdue payment.
Representatives of "Kirovenergo" did not challenge the fact of the delay but insisted that the amount of the penalty was disproportionate. They requested the court to significantly reduce the size of the penalty, citing that "Kommunenergo" also committed violations that affected the timing of payments.
However, all three instances of the courts — first, appellate, and cassation — consistently dismissed "Kirovenergo's" arguments. The rulings state that the fact of debt and delay is proven, and there are no grounds for reducing the penalty. The courts concluded that "Kirovenergo," as a professional market participant, should have foreseen the consequences of breaching its obligations.
