The bailiffs of the Novovyatsky district were executing an enforcement order to collect debts from the man in the amount of 19 thousand rubles. He did not plan to repay it on his own and on time and evaded payment in every possible way.
The bailiff seized the debtor's cell phone and, in accordance with federal law, left it for safe custody with the right to use it.
So, due to the fact that the man did not pay the debt, the bailiff sent a request for the provision of a phone for further seizure and sale. At the same time, the debtor lied to the bailiff about the loss of the specified phone. At the same time, the resident of Kirov knew about the illegality of his actions and was warned about criminal liability for illegal actions in relation to the seized property entrusted to him.
In this regard, the investigator of the GUFSSP of Russia in the Kirov region opened a criminal case under Part 1 of Article 312 of the Criminal Code of the Russian Federation. After the indictment was approved, the case was sent to court. As a result, the man was found guilty of committing a crime under Part 1 of Article 312 of the Criminal Code of the Russian Federation and, taking into account the sentence not served earlier, sentenced him to forced labor for a period of 3 years and 2 months withholding 10% of wages to the state income.
