Kirov resident who beat a teenage janitor has been sentenced

      On October 12, a 35-year-old resident of Kirov, standing at the entrance of an apartment building at 1 Herzen Street, complained to a 16-year-old teenager janitor about the quality of cleaning of the house territory. After that, he struck the guy several times with his hands and body in the lower back. At the hearing, the man explained that at that time he disliked the victim because of the wind blowing that was making noise in front of the windows of his apartment.

      A criminal case was opened against the man. He was found guilty under Article 116 of the Criminal Code of the Russian Federation (beatings committed for hooligan motives). The court agreed with the prosecutor's opinion and sentenced the Kirov resident to 8 months in prison.

      However, taking into account the information about the defendant's identity, the severity of the crime and other circumstances, the court applied the provisions of Article 53.1 of the Criminal Code of the Russian Federation as an alternative, replacing the punishment of imprisonment with forced labor for the same period with deduction from the defendant's salary to the state income of part of earnings.

      In addition, defending the rights of the teenager, the prosecutor supported the previously stated claims to recover compensation from the defendant for moral damage caused by beatings. Monetary compensation in the amount of 50 thousand rubles was collected from the offender.
