Kirov residents were told what can be considered discrimination when applying for a job
According to experts hh.ru Many job seekers face discrimination when applying for a job without even knowing it. The labor legislation of the Russian Federation strictly regulates which factors an employer does not have the right to take into account when considering a candidate.
What is labor discrimination? These are restrictions on employment or, conversely, the provision of advantages due to gender, race, nationality, age, place of residence, interests, property status, past mistakes or other personal circumstances that are not related to the candidate's business qualities.
What factors are prohibited by the Labor Code of the Russian Federation?
Appearance and nationality: References to "Slavic appearance" or preferences of a particular nationality are prohibited. Piercings and tattoos cannot be the reason for rejection.
Religion and beliefs: The employer has no right to inquire about the candidate's religious views and political beliefs.
Gender: References to "male" or "female" groups are prohibited. Exceptions can only be in the creative field, where there is a division into male and female images, as well as in some professions defined by the order of the Ministry of Labor.
Marital status and the presence of children: Questions about plans for children and refusal to work for a pregnant woman (if the work is not associated with harmful working conditions) are a direct violation of the Labor Code of the Russian Federation.
Age: Age restrictions in vacancies are usually unacceptable, except in certain cases provided for by law (for example, when applying for public service).
Property status: The requirement to have a personal car or laptop to perform work tasks is illegal.
Place of residence: Lack of registration cannot be the reason for refusal of employment.
Hobbies: A candidate's strange or unusual hobbies cannot be grounds for refusal.
Criminal record: Having a criminal record is not an obstacle to employment, except in cases provided for by law.
Zodiac Sign: Despite the growing demand for astrologers and tarologists, the zodiac sign is not a legitimate reason to refuse to work.
When should I contact the Labor Inspectorate?
If you encounter the above-mentioned discriminatory job requirements or interview questions, this is a reason to contact the Labor Inspectorate. It is important to remember that the employer is obliged to evaluate candidates solely on the basis of their professional skills and experience, and not on personal characteristics unrelated to the job.
