Article 575 of the Civil Code of the Russian Federation indeed prohibits employees of educational organizations from accepting gifts worth more than 3,000 rubles from students and their relatives. However, as experts note, this prohibition only concerns the formal exceeding of the amount and does not make an ordinary bouquet an automatic criminal offense.
— A teacher is not a practicing appraiser and cannot determine the value of a bouquet at a glance, — explained Kirov lawyer Yan Chebotarev in a conversation with the editorial staff. — If it is an ordinary, decently arranged bouquet, and not 350 red roses or a golden Parker, it can be safely accepted without fear of accusations of corruption.
According to Chebotarev, for a gift to be classified as a bribe, there must be a selfish component: the value must be given for specific actions or inaction in service — for example, for a grade, special treatment of a child, or resolving an exam issue. If the gift does not imply a reciprocal provision of a service, there is nothing wrong with parents giving a teacher a bouquet. However, the lawyer still recommends that educators be cautious if the gift is accompanied by a receipt with a high price — in such a situation, it is better to decline the present.
Colleagues from the TG channel "Lawyer Zhorin" agree with him. They also draw parents' attention to another important nuance: if the whole class pooled together 500 rubles each and bought one common gift for 15,000, its value is not divided by the number of students. It is still one gift worth 15,000 rubles, not 30 gifts worth 500 each.
“So this year, the most reliable way not to put your favorite teacher in an awkward position is either to choose a gift up to 3,000 rubles or to limit yourself to a symbolic greeting,” the experts added.
