Legal residents of the house are sent into the darkness of lawlessness.
As reported to the residents by the building owner (formerly the dormitory of the Kirovagropromproekt Institute of the Management Systems JSC), the supply of electrical energy will be (quote) "terminated no earlier than five days" due to unauthorized consumption and the absence of contractual relations.
At the same time, according to the notification, further residence is only possible if a "rental bondage" is signed with the building owner and only on his terms. That is, the mandatory conclusion of a lease agreement for the premises — at a rate of 20,000 rubles per month, plus utilities (as paid by other residents of the dormitory), which is unfeasible for people whose pension does not exceed 16,000 rubles. Also, the repayment of supposedly previously accumulated debt, calculated by summing nonexistent rental payments (from 250,000 to 400,000 rubles in different apartments). And another 15,000 for connecting electricity.
As stated separately, for unauthorized connection, citizens will be held administratively liable under Article 7.19 of the Administrative Offenses Code with a fine of 10,000 to 15,000 rubles.
By the way, for those who like to give advice to the "problematic residents of the house at Gorky, 54-a": they say, contact the police, which will take action, we inform you that on May 8, pensioner Irina Karacheva filed a complaint with the Ministry of Internal Affairs about the illegal disconnection of electricity. And if we count from the date of disconnection — May 5, then the waiting period for any police response — written or for reconnection — is approaching two months.
Dancing on rakes to someone else's songs
As lawyer Tatyana Bazhina, representing the interests of five families, reported, on Wednesday, June 24, a petition for "imposition of protective measures" will be submitted to the Lenin District Court before considering the residents' lawsuit about "obstruction by the new owner of the building" — the Management Systems JSC.
As stated in the application, among numerous prohibitions, there is an embargo on entering the house and apartments, in which, as people believe, they have lived legally for almost half a century; on the ability to use the elevator in the 9-story building, on the absence of an electronic key, and coercion to "humiliating document checks."
The application also contains a demand for compensation for moral damage in the amount of 500,000 rubles (for each of the 10 people). And material "claims" for three years of almost daily two-hour waits behind the closed doors of the dormitory (including in the cold), as well as the inability to take medicine on time, wait for an ambulance, and invite grandchildren to their grandmother — do not seem particularly excessive to the plaintiffs. Rather, they seem quite modest and even insufficient.
Is Vasilyev's hand visible?
Let us recall that in 1988, the Kirovagropromproekt Institute built a nine-story dormitory at Gorky Street, 54-a with 400 one- and two-room apartments. Social rental orders with the right to indefinite residence (even in case of dismissal and staff reduction) were issued to young specialists and families with children.
In September 2017, the Rosreestr re-registered the residential building as non-residential, despite the legal residence of hundreds of Kirov families in it. And officially recognized as non-residential, the nine-story building was "transferred" to the LLC "UK Gorky" in the same year.
In August 2020, the building passed into the ownership of the Management Systems JSC, along with the "dormitory content." This gave residents a reason to bitterly joke that the state institution "traded people like meat-filled chebureks," as there were no details about what would happen to the citizens who had already lived in the dormitory apartments for 35 years.
By the way, regarding the former Kirov governor Igor Vasilyev, who was appointed head of the region in 2016, the federal press has repeatedly written that the Kirov region has become almost an exile for Vasilyev, under whom the Rosreestr allegedly "began to encrypt the owners of expensive real estate in open access."
And one of the significant reasons for the "encryption" was certainly not Igor Vladimirovich's explanation: "So that uninvited guests do not wander around," but the version that when information is classified, "uninvited guests" find it harder to access knowledge, for example, what real estate (factories, dormitories, buildings) and on what grounds passed into the ownership of "known individuals" and their companies. Among which Vasily Ilnitsky undoubtedly belongs — today one of the "co-owners" of the building at Gorky, 54-a.
Blitzkrieg turned into a protracted "conflict"
By the way, in an interview with one of the Kirov business publications, Vasily Ilnitsky, then general director of OJSC NIPII "Kirovproekt," and now "co-owner" of the former dormitory building, stated his credo: "Where diplomacy ends, war begins." Today, he has engaged in a "military conflict" with the dormitory opponent — mainly with elderly ladies of considerable pension age. Not taking into account that for the current "capturing strategy," one boldness is clearly not enough.
And the courts have long been unwilling to simply freeze, fuss, and salute only at the sight of the dubious "might of the applicant," especially represented by a little-known LLC and an equally insignificant JSC. Instead, they prefer to follow the law, common sense, and understanding of the value and integrity of the mantle.
Thus, promising "hellish living conditions" to the rebellious residents of the former dormitory, who categorically do not want to sign a "contract for serfdom," Ilnitsky has intensified the eviction procedure. Along the way, "sorting things out" — probably hoping to initiate a criminal case "for slander" — with a journalist from Newsler.ru.
At the same time, there is a passionate and probably gratuitous initiative from officer Mikhail Bezdenezhny, persistently denying the legality of the residence of several families in the "disputed house." For the police major, a mark in the passport about registration (registration) in an apartment obtained on a legal basis back in the USSR is nothing more than "the opinion of people" who disagree with Vasily Grigorievich's conviction. Also, lawyer Mezentsev, probably together with the officer, convinced that if when filing administrative protocols in court it is indicated that the defendants are "illegally residing," then it will take minutes until the verdict is announced.
However, neither the courts nor the readers of Newsler.ru agree with the "truthfulness of the information about the apartment debt of the 'illegally living,' which has reached, as the building owners claim, 250,000 to 400,000 rubles — after all, why scandal and resort to violence if, by court decision, non-payers can be evicted? And the answer, if not obvious, is suggested: the new owner does not go to court with a demand for collection or eviction, as he probably cannot provide any evidence of the huge debt.
And the question of why the constitutional right to housing, especially for those who have no other and cannot have one in the foreseeable future, should be canceled at the owner's whim? Who surely knew that he was buying a house along with people... And it is hardly a sufficient explanation that there are two train stations near the former dormitory, and there are free — with all amenities — places under the bridge. As well as in old-age homes or shelters for the homeless, where, probably, in the landlord's opinion, is the best place for active people with higher education. And the poverty of the interior will be brightened up by Honorary Certificates of socialist labor shock workers.
As Tatyana Bazhina explained, employees of the Migration Service will be invited to the nearest court process, who — there is hope — will be able to explain why the registration stamps, placed by the predecessor of the agency — the Passport Office, raise doubts about their legality and legitimacy. And if there is reason to doubt, why does the Ministry of Internal Affairs not deprive people — not debtors, not troublemakers — of their 40-year registration?
