The Prosecutor's Office of the Novovyatksy District of Kirov conducted an investigation into an IT crime involving a 60-year-old woman. The pensioner became a victim of fraud: scammers unlawfully seized 80,000 rubles belonging to the victim.
A criminal case was initiated based on part 2 of article 159 of the Criminal Code of the Russian Federation (fraud).
During the investigation, it was revealed that the stolen funds were transferred for subsequent cashing out to the bank account of a dropper. This front person resides in the Novosibirsk region.
The problem was that the elderly woman, due to her age and other life circumstances, could not independently protect her interests in civil court. Therefore, the prosecutor's office intervened.
The supervisory agency filed a lawsuit, but not directly for compensation for damages in the criminal case, but with a demand to recover the amount of unjust enrichment. The court supported this position.
The result was the full execution of the decision: the defendant — the very account holder from the Novosibirsk region — fully compensated the Kirov pensioner for the material damage caused. The money was returned to the woman.
