      In the autumn of 2023, representatives of JSC "KirovPassazhirAvtotrans" and Nizhny Novgorod LLC "Russian Bus — Povolzhye" concluded three contracts for the supply of buses. The deadline was December 25 of the same year. The supplier delivered only two buses within the prescribed period. The remaining 30 were delayed by between 5 and 95 days.

      "KPAT" charged the supplier penalties in the amount of 258,000 rubles and demanded payment. However, the company refused to pay, which led the representatives of KirovPassazhirAvtotrans to file a claim in the regional arbitration court. They sought to recover the penalties and court fee expenses of 17,900 rubles.

      In court, the defendant stated that it did not agree with the claims. Despite this, the court of first instance fully granted the claim. The supplier filed an appeal, but the Second Arbitration Appellate Court left the decision unchanged.
