On the evening of January 15 of this year, a 56-year-old resident of Kirov got behind the wheel of a Hyundai Solaris and drove through the streets of the city. At some point, driving near the house No. 96 on Molodaya Gvardiya St., in the presence of obvious signs of intoxication, he was detained and removed from driving by traffic police inspectors.
When checking the identity of the violator, it turned out that the man had previously been brought to administrative responsibility for drunk driving. At that time, he was sentenced to a fine of 30,000 rubles and disqualification from driving for one year and six months.
This time, he was again found guilty under Part 1 of Article 264.1 of the Criminal Code of the Russian Federation (driving under the influence of a person who has been subjected to administrative punishment or has a criminal record). The court agreed with the prosecutor's opinion and sentenced the drunk driver to 240 hours of compulsory labor with the deprivation of the right to drive vehicles for two years. In addition, the court applied the provisions of art. 104.1 of the Criminal Code of the Russian Federation (confiscation of property), making the offender's car the property of the state.
