В мае Арбитражный суд Кировской области рассмотрел иск индивидуального предпринимателя из Кирова к страховой компании «РЕСО-Гарантия». Истец требовал взыскать сумму в размере 239 740 рублей. Суд установил, что в ноябре 2023 года произошло ДТП, в результате которого была повреждена иномарка. После инцидента владелец автомобиля обратился к страховщику с просьбой о возмещении убытков и выбрал организацию для ремонта. Однако позже он отказался от ремонта из-за использования неоригинальных и б/у запчастей.
В феврале 2024 года один из предпринимателей в Кирове подписал договор с владельцем иномарки о передаче ему прав требования по договору ОСАГО. Он потребовал от страховщика оплатить рыночную стоимость ремонта и неустойку. Страховая компания отказала, указав, что исполнила свои обязательства, выдав направление на ремонт. Суд встал на сторону страховщика и отклонил иск. На днях Второй арбитражный апелляционный суд оставил решение суда первой инстанции без изменения.
