The Kirov Capital Repair Fund won the lawsuit against its contractor.
In the spring of 2023, the Capital Repair Fund signed a contract with a firm from Kazan to assess the condition of buildings in Kirov on Karl Marx Street (now Vladimirskaya), numbers 30 and 35, as well as to develop a capital repair project and carry out the work itself. In the autumn of the same year, the Fund decided to unilaterally terminate the contract due to a significant violation of the deadline for completing the development of project documentation. After some time, the contractor sent a letter to the customer, indicating the submission of project documentation, and demanded payment for the completed work. The Fund refused to do so.
The contractor turned to the Arbitration Court of the Kirov Region, demanding to recover 817 thousand rubles from the Fund for the project and 324 thousand rubles in penalties. Representatives of the Fund opposed this, stating that the project was sent to them after the contract was terminated and, moreover, it did not meet the technical specifications.
The court came to similar conclusions. It ruled to deny the claim. The contractor filed an appeal; however, the Second Arbitration Appeal Court, which reviewed it, did not change anything.
