The court allowed the removal of illegal advertising at the shopping center on Koneva.

      An individual entrepreneur, who owns a land plot and a shopping center building on Marshal Konev Street, attempted to challenge in court the order of the Kirov administration regarding the dismantling of advertising structures. Metal advertising panels were discovered by specialists from the Municipal Institution "City Advertising" on the territory of the plot. There was no permit for their installation.

      Before issuing the order, the administration published an announcement and sent inquiries to organizations operating in the shopping center to identify the owners of the structures. No responses were received.

      The Arbitration Court of the Kirov Region denied the entrepreneur's request to recognize the order as invalid, stating that it complies with the law. In the appeal, the businessman referred to the fact that the inspection was conducted without coordination with the prosecutor's office and without prior notification. However, the Second Arbitration Appeal Court rejected these arguments.

      The court explained that the order for the dismantling of structures installed without permission does not require a separate on-site inspection under the law on the protection of entrepreneurs' rights — it is a measure to stop an already identified violation. The administration had sufficient legal grounds for its issuance.

      The entrepreneur's cassation appeal was also left unsatisfied by the Arbitration Court of the Volga-Vyatka District.
