The Investigative Committee proposed to make confiscation a separate type of punishment.
The advisor to the head of the Investigative Committee of Russia, Alexander Fedorov, reported that the agency proposes to revisit the issue of confiscation as a separate form of punishment — primarily for corruption-related crimes. According to him, society has the right to expect not only imprisonment from the convicted but also the seizure of all property acquired through illegal means, as reported by "Kommersant."
The Investigative Committee also suggested allowing the search for criminal assets after the investigation is completed or even after the death of the suspect. As Fedorov explained, in practice, property is often found only after the case has been transferred to court, when current legislation does not allow for the seizure of newly discovered assets.
It should be noted that the initiative to "return" confiscation of property to the Criminal Code is not new. Back in 2016, deputies in the State Duma proposed a bill on this topic. At that time, confiscation was suggested as an additional measure of punishment for those convicted of serious and particularly serious crimes. Two years later, in 2018, the issue was raised again, but the bill was never passed. Only in 2024 did the State Duma announce the adoption of a law on the confiscation of property for crimes against national security.
