      This will already be the second and, probably, quite predictable — in terms of the final result — attempt by the Department of Municipal Property (DMP) to hand over a "fat piece" to one of the Kirov special developers, who is directly or affiliated with Roman Golyshev (LLC Construction Company "Trans-Holding").

      The initial bureaucratic auction effort was suspended by a court decision on October 27, 2025, imposing protective measures on the formed land plot, which borders to the west with the territory of the city administration, to the south with the main and auxiliary buildings of the "tax office." In the northern sector, it borders with an apartment building at Nikitskaya, 145-a, and to the east it adjoins three private allegedly "inactive Golyshev land plots."

      Approval for conducting a repeated auction procedure was received on May 26 following the verdict of the Regional Court, where residents of the emergency house at Orlovskaya Street, 48/1, appealed against the decision of the first instance, claiming that they have a rightful common share ownership of a land plot of about 15 hundredths, distributed in shares proportional to the area of their apartments. The DMP, as the organizer of the auction, could not have been unaware of this, as there is a note about it in the urban planning plan.

      And, as it might seem to an amateur, if there is a land plot and its owners, then the expropriation of 20 hundredths without their good consent is impossible. Moreover, the house was demolished, probably by the residents themselves, who explained that they were frightened by the city administration's order "to demolish the emergency house within the specified time." In case of disobedience, the residents were threatened with "the procedure for expropriating apartments."

      This was essentially the basis for the residents' complaint to the appellate instance, which was only beneficial to the city officials. According to the Urban Planning Code and the law "On State Registration of Real Estate," if there are apartments in an emergency house, they are subject to expropriation for the formation of a KRT plot. But, as in the case of the building at Orlovskaya, 48/1, where only the walls of the dilapidated two-story building were demolished and the foundation remained untouched, the court considered the existence of the house and 12 apartments to be a proven fact. Moreover, the completion of the demolition was not registered by the cadastral engineer, and no mandatory note was made in the Urban Plan and the Information System for Urban Planning Activities.

      So the question of conducting a repeated auction for "central land" is just a matter of time, as the issue of the possibility of expropriating apartments has been fully resolved.

      And the responsibility for compensating the residents of the 12 apartments will fall on the tenant of the municipal land, who will be determined within the auction framework. Some of them, having believed the promises that they would receive a "decent settlement" if they refused to participate in the court process, will be equally shocked by the amount they will receive as compensation.

The residents should have demolished everything cleanly, even scraping the foundation with spoons; then the auctions would have collapsed... After all, the law unfortunately does not allow expropriating land owned by a private owner for KRT. So Roman (probably referring to Golyshev) would have to build around or along the arc of someone else's land plot," shares knowledge and experience one of the well-known Kirov developers.

      By the way, as the interlocutor suggested, today, when all obstacles for concluding a KRT contract on "the most central municipal land" have been removed, and moreover, even a servitude for the passage of construction equipment has been laid — through the yard (children's playground, parking) of the apartment building at Nikitskaya, 145-a, Kirov builders have something to "think hard about."
