A complaint has been received for the competition for the improvement of the 50th Anniversary of the VLKSM Park.

      Recall that earlier the Kirov authorities announced the search for a contractor who will take care of the improvement of the territory near the Palace of Creativity - the Memorial, that is, the territory of the 50th Anniversary of the VLKSM Park in Kirov. 375.9 million rubles have been allocated for this.       Meanwhile, as reported on the government procurement website, a complaint was submitted to the competition, and the determination of the contractor has been temporarily suspended. The complaint was filed by the construction company "Sodeystvie" from Ufa. It pointed out several violations that, in its opinion, are present in the competition documentation.

      First of all, as noted by the company, the customer set a requirement that participants in the competition have experience in the field of construction (repair, major repairs, reconstruction) of roads. At the same time, the contract will be concluded for improvement, that is, for a completely different type of work.

      In addition, the company notes that the contract project simultaneously stipulates conditions for the presence of an advance (10%) and a ban on its payment. There is also a discrepancy in the information about the advance, posted in the contract project and in the procurement notice. Finally, the company found violations of the Civil Code, expressed, in its opinion, in that the contract project obliges the contractor to carry out work continuously, whereas by law the contractor has the right to suspend work if the customer does not fulfill its obligations.

      In the coming days, all these arguments will be considered by the commission of the Federal Antimonopoly Service of Russia for the Kirov region. It should be noted that a response from the Kirov officials who announced the competition is also posted on the government procurement website. They commented on their requirement regarding the contractors' "road" experience. The authorities believe that there are no violations and that contractors with "road" experience will cope excellently with the improvement of the park. Moreover, they usually have all the necessary equipment.
