
Contributions for the overhaul of new buildings will begin to accrue earlier
The Ministry of Construction and Housing and Communal Services of Russia has developed draft amendments to the Housing Code, suggesting a significant reduction in the deferral period for the payment of contributions for major repairs for new buildings. The document is published on the portal of draft regulatory legal acts.
According to the explanatory note, it is proposed to reduce the maximum period of deferred payment of contributions from five years to one. This is due to the fact that modern apartment buildings are equipped with expensive engineering systems and are made using complex materials, the service life of which begins from the moment the building is put into operation. Therefore, as the developers emphasize, the start period of payment should be as close as possible to the actual start of using the house.
The relevant amendments are planned to be made to articles 170 (paragraphs 5.1 and 5.2) of the Housing Code, which regulate the formation of the capital repair fund.
In addition, the draft provides for amendments to Article 156 of the Housing Code of the Russian Federation. In particular, it is proposed to expand the list of factors affecting the minimum contribution for capital repairs. Among the new criteria is the presence of an elevator in the house, as well as arrears for previously completed work, payable from the fund.
The Ministry of Construction also proposes to establish a rule protecting the rights of owners in the event of decisions on contributions exceeding the established minimum. It is assumed that it will be impossible to change such decisions if the fund's funds are insufficient to fulfill the obligations already assumed.
